Terms of Service

 

Aviantum Weather

 

Effective Date: November 1, 2025

 

These Terms of Service (“Terms”) govern your access to and use of Aviantum Weather (the “Service”), a mobile application and related services operated by Aviantum, LLC, a Delaware Limited Liability Company with its headquarters in Washington, DC, United States (“Aviantum,” “we,” “us,” or “our”).

 

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Eligibility

​

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have the consent of a parent or legal guardian to use the Service.

 

By using the Service, you represent that you are legally permitted to do so under applicable laws and regulations.​

 

2. Description of the Service

 

Aviantum Weather provides aviation weather information, summaries, and tools intended to support situational awareness and flight planning.

 

The Service is informational and decision-support only. It does not provide operational control, instruction, or command authority over any aircraft or flight operation.

 

Features of the Service may change over time, and some features may be offered on a subscription basis.

3. License Grant (Embedded EULA)

​

Subject to your compliance with these Terms, Aviantum grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Service for your personal, non-commercial use on supported devices.

 

This license does not grant you any ownership rights in the Service.

License Restrictions

​

You may not:

 

  • Copy, modify, distribute, sell, lease, or sublicense the Service or any portion of it

  • Reverse engineer, decompile, or attempt to extract source code

  • Use the Service to develop or support a competing product or service

  • Circumvent or interfere with security or access controls

  • Use the Service in any unlawful manner

4. Ownership and Intellectual Property

 

The Service, including all software, content, text, graphics, audio, trademarks, and logos, is owned by or licensed to Aviantum, LLC and is protected by intellectual property laws.

 

All rights not expressly granted to you under these Terms are reserved by Aviantum.

5. Aviation Disclaimer and Assumption of Risk

 

PLEASE READ CAREFULLY

 

5.1 Informational and Decision-Support Only

 

The Service provides aviation weather information and summaries for informational and decision-support purposes only. It is not operational control software and does not direct or control aircraft operations.

​

5.2 Not an Official Weather Briefing

 

The Service is not an official weather briefing and is not certified, approved, or endorsed by the Federal Aviation Administration (FAA), the National Oceanic and Atmospheric Administration (NOAA), the National Weather Service (NWS), or any other aviation authority.

 

The Service does not replace FAA-approved weather sources, preflight briefings, or pilot responsibilities.

 

5.3 Data Limitations

 

Weather data and summaries provided by the Service may be delayed, incomplete, inaccurate, aggregated, summarized, or interpreted. Aviantum does not guarantee the accuracy, completeness, or timeliness of any information provided.

5.4 Pilot Responsibility

 

The pilot in command (PIC) is solely responsible for preflight planning, weather interpretation, go/no-go decisions, compliance with aviation regulations, and the safe operation of the aircraft.

 

Users are responsible for verifying information using official and authoritative sources as appropriate.

​

5.5 Not Flight Instruction or Training

 

The Service does not provide flight instruction, ground instruction, aeronautical training, or instructional guidance of any kind.

 

The Service does not replace, supplement, or substitute for instruction, training, or guidance that may be provided by a certificated flight instructor (CFI), flight school, training organization, or other qualified aviation professional.

 

Users remain responsible for seeking appropriate instruction, training, and proficiency as required by applicable regulations and good airmanship.

 

5.6 Weather as One Component of Aeronautical Decision Making

 

The information presented by the Service represents only one aspect of the broader weather picture, which itself is only one component of comprehensive flight planning and aeronautical decision making.

 

Safe flight planning and operation require consideration of numerous factors beyond weather, including but not limited to aircraft performance, pilot experience and proficiency, fuel planning, airspace, NOTAMs, operational limitations, and risk management.

 

The Service does not evaluate, integrate, or assess all factors relevant to a specific flight and must not be relied upon as a complete or determinative basis for any operational decision.

 

5.7 Not for Real-Time or Sole In-Flight Reliance

 

The Service is not intended to be relied upon as the sole or real-time source of weather information during flight operations.

5.8 Not for Emergency Use

 

The Service is not intended for emergency use.

​

5.9 Assumption of Risk

 

Aviation involves inherent risks that cannot be eliminated. You acknowledge and agree that your use of the Service is at your own risk.

6. No Warranties

​

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVIANTUM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

 

AVIANTUM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR AVAILABLE AT ANY PARTICULAR TIME.

7. Limitation of Liability

​

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

 

  • AVIANTUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS.

  • AVIANTUM’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE DURING THE TWELVE (12) MONTHSPRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations, so these limits may not apply to you in full.

​

8. Indemnification

​

You agree to indemnify, defend, and hold harmless Aviantum, LLC and its officers, directors, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

 

  • Your use or misuse of the Service

  • Your violation of these Terms

  • Your violation of applicable laws or regulations

9. Subscriptions and Billing

​

Some features of the Service may require a paid subscription.

 

  • Subscriptions are billed through the Apple App Store or Google Play Store

  • Billing, renewal, cancellation, and refunds are governed by the applicable platform’s policies

  • Aviantum does not control platform billing processes

​

10. Acceptable Use

​

You agree not to:

 

  • Use the Service unlawfully or for unauthorized purposes

  • Interfere with or disrupt the Service or related systems

  • Attempt unauthorized access to systems or data

  • Use the Service in violation of aviation laws or regulations

​

11. Service Availability and Changes

​

Aviantum reserves the right to modify, suspend, or discontinue the Service or any feature at any time, with or without notice.

 

Aviantum is not obligated to maintain any specific feature or functionality.

​

12. Termination

​

Aviantum may suspend or terminate your access to the Service if you violate these Terms.

 

You may stop using the Service at any time. Upon termination, the license granted to you under these Terms will immediately terminate.

13. Privacy

​

Your use of the Service is subject to Aviantum’s Privacy Policy, which describes how we collect and use personal information. The Privacy Policy is incorporated into these Terms by reference.

​

14. Governing Law and Venue

​

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles.

 

Any legal action arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Delaware.

​

15. Changes to These Terms

​

Aviantum may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
